We assist clients through our main offices in Milan, Rome, and Bologna in structuring IT transactions in a manner that maximizes their economic benefit while ensuring regulatory compliance and, where possible, reducing the risk of litigation. Information technology law encompasses various aspects of contract law, intellectual property law, software protection, privacy, and data protection law.
The field of intellectual property includes matters relating to copyrights, domain names, trademarks, trade names, website names, and related rights, as well as rules concerning fair use, digital copy protection systems, and the circumvention of such technological protection measures.
The area of software protection includes licence agreements (including end-user, free software, and open- source licences), product and professional liability of individual developers, warranties (including performance, installation, troubleshooting, and user training), limitations of liability and indemnification clauses for vendors (including ISPs, software and hardware manufacturers, network providers, and mainframe distributors), infringement disclaimers, payment and financing terms, and related matters.
The field of electronic signature law involves advising clients on the applicable legal framework, including the Uniform Electronic Transactions Act and the Electronic Signatures in Global and National Commerce Act, particularly with regard to customer consent disclosures, record retention obligations, and document reproduction capabilities.
Privacy law concerns unauthorized access, data protection, privacy rights, and spamming, as well as legal issues related to online trade, including taxation, consumer protection, and advertising regulations, together with class action consumer litigation. We also conduct legal assessments concerning jurisdiction over content published on the Internet for e-commerce purposes.
